These Terms of Use govern your use of the Carity iOS app, related backend services, and associated public website pages provided by Carity trading as Airhop Labs Limited ("Carity", "we", "us", or "our").

By downloading, accessing, or using Carity, you agree to these Terms.

1. Eligibility and Acceptable Use

You may use Carity only in compliance with applicable law and these Terms. You agree not to:

  • misuse the app or backend services;
  • try to bypass device-trust, authentication, entitlement, or access controls;
  • scrape, probe, overload, reverse engineer, or interfere with the service except as allowed by law;
  • use the service in a way that could harm other users, our infrastructure, or third-party providers; or
  • use Carity for unlawful, deceptive, or abusive activity.

You are responsible for keeping your device, Apple account, and app environment secure.

2. What Carity Provides

Carity currently supports features such as:

  • fuel and station discovery;
  • saved favourites;
  • fuel-price alerts;
  • vehicle and reminder features;
  • push notifications; and
  • premium or entitlement-aware functionality where offered.

Some features depend on third-party data, Apple services, network availability, trusted device status, or paid entitlement state.

3. No Guaranteed Availability

We may change, suspend, restrict, or discontinue any part of Carity at any time, including features, integrations, or supported product tiers.

We do not guarantee that:

  • station, price, route, or reminder data will always be available, complete, or up to date;
  • notifications will always arrive on time;
  • the service will always be uninterrupted or error-free; or
  • premium features will remain identical over time.

4. Third-Party Services and Data

Carity depends on third-party services and data sources, including Apple services, infrastructure providers, and upstream fuel or vehicle-data services.

We are not responsible for failures, delays, pricing discrepancies, or inaccuracies caused by third-party systems or data sources.

Fuel prices, station availability, route information, reminder data, and vehicle lookup information should be treated as informational only and checked independently where needed.

5. Safety and Driver Responsibility

You must use Carity responsibly and lawfully.

Do not interact with the app while driving in a way that is unsafe or unlawful. You remain responsible for your own driving decisions, route choices, fuel purchases, and vehicle maintenance obligations.

Carity is not legal, roadside, mechanical, insurance, tax, MOT, or emergency advice.

6. Device Trust, Access, and Suspension

Carity uses device-trust and authentication controls to protect the service.

We may refuse, restrict, or terminate access if we reasonably believe:

  • a device or request is unauthorised, compromised, or abusive;
  • entitlement or subscription state is invalid;
  • use of the service creates operational, legal, or security risk; or
  • suspension is necessary to protect users, providers, or the service.

7. Purchases, Subscriptions, and Tips

Certain features may require a paid App Store subscription or may allow optional one-off tip purchases.

  • Purchases are processed by Apple, not by Carity directly.
  • Apple is the merchant of record and controls billing, renewals, refunds, and payment methods.
  • Subscription details shown in the app or App Store listing form part of the offer presented at purchase time.

8. Intellectual Property

The Carity app, brand elements, software, content structure, backend services, and related materials are owned by us or our licensors and are protected by intellectual-property laws.

These Terms give you a limited, non-exclusive, non-transferable, revocable right to use Carity for personal, non-commercial use, subject to these Terms.

9. Feedback

If you send us ideas, suggestions, or feedback, you agree that we may use them without restriction or compensation, unless applicable law requires otherwise.

10. Disclaimers

To the maximum extent permitted by law, Carity is provided "as is" and "as available".

We disclaim implied warranties to the extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Nothing in these Terms excludes liability that cannot legally be excluded.

11. Limitation of Liability

To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenues, goodwill, data, or business opportunity arising from or related to your use of Carity.

Where the law allows a liability cap, our aggregate liability for claims arising out of or relating to Carity will not exceed the greater of:

  • the amount you paid us for Carity in the 12 months before the event giving rise to the claim; or
  • GBP 100.

This clause applies only to the extent permitted by law.

12. Termination

You may stop using Carity at any time.

We may suspend or terminate your access as described in these Terms. Clauses that by nature should continue after termination will continue, including intellectual-property, disclaimers, liability, and dispute-related terms.

13. Governing Law

These Terms are governed by the laws of England and Wales, unless mandatory local consumer law requires otherwise.
